OfferQS VOW Terms of Use (HAR MLS Listing Information)

Who is providing this information

OfferQS is a Virtual Office Website ("VOW") operated by FiveRivers Company LLC on behalf of, and under the supervision and accountability of, Central Metro Realty (the "Participant"), a participant in the Houston Association of REALTORS® Multiple Listing Service operated by Houston REALTORS® Information Service, Inc. ("HAR MLS"). Rupinderjit Singh, a Texas real estate sales agent sponsored by Central Metro Realty (TREC license no. 842132), is the licensee responsible for the VOW. (19.1(a), 19.14)

These VOW Terms apply in addition to the OfferQS Terms of Service and Privacy Policy. Where they conflict about MLS Listing Information, these VOW Terms control.

1. Registration

1.1 To search or view MLS Listing Information you must register with your name and a valid email address, confirm that address, and accept these Terms by clicking "I agree" after they have been displayed to you. We will send a confirmation email recording your acceptance. (19.3(a)(ii), (d))

1.2 Your email address is your user name. Your credential is issued and renewed by OfferQS through your verified email address (a one-time sign-in code or link), is unique to you, expires [90] days after issuance, and may be renewed by verifying your email again. One email address may be associated with only one registrant. (19.3(a)(iii), (b))

1.3 We keep a record of your name, email address, user name and current credential for at least 180 days after the credential expires, and an audit trail of your activity on the VOW. If HAR MLS has reason to believe a breach of security or a rule violation has occurred, we must provide that record and audit trail to HAR MLS on request. (19.3(b), (c))

2. Your acknowledgments (required by the MLS)

By accepting these Terms you acknowledge and agree that: (19.3(d)(i)–(v))

(a) you are entering into a lawful consumer-broker relationship with Central Metro Realty, as defined by Texas law, for the purpose of receiving real estate information through this VOW;

(b) all information you obtain from the VOW is intended only for your personal, non-commercial use;

(c) you have a bona fide interest in the purchase, sale or lease of real estate of the type offered through the VOW;

(d) you will not copy, redistribute or retransmit any of the information provided, except in connection with your own consideration of the purchase, sale or lease of an individual property; and

(e) HAR MLS owns, and holds a valid copyright in, the MLS database and the MLS Listing Information, and you will not challenge that ownership or copyright.

You also expressly authorize HAR MLS, and other MLS participants or their duly authorized representatives, to access this VOW to verify compliance with MLS rules and to monitor the display of participants' listings. (19.3(f))

3. What this relationship is and is not

3.1 These Terms create no financial obligation for you and no representation agreement. Accepting them does not make Central Metro Realty, Rupinderjit Singh or FiveRivers your agent, and does not create a fiduciary duty. Any agreement for representation or for fees must be a separate, prominently labeled written agreement that cannot be accepted by a mouse click. (19.3(e))

3.2 As required by Texas law, the Texas Real Estate Commission's Information About Brokerage Services notice and Consumer Protection Notice are provided at registration and linked on every page. Reviewing them is part of registering. (19.3(a)(i); TREC §531.18, §531.20)

3.3 OfferQS is decision-support software. Calculations, comparables, rent evidence, estimates and findings are produced from the inputs and sources shown with them and are not appraisals, broker price opinions, investment advice or guarantees. See the Terms of Service.

4. The information you will see

4.1 MLS Listing Information on this VOW consists of active listings and sold or leased data supplied by HAR MLS, refreshed at least every three days and in practice within hours; the date of the last update is shown. (19.1(d), 19.9; IDX 18.2.5)

4.2 MLS Listing Information is deemed reliable but is not guaranteed accurate by the MLS. Verify any fact that matters to you. (19.17)

4.3 Every listing identifies the listing firm and listing agent. Listings obtained from any source other than HAR MLS identify that source. (19.18, 19.20; NAR IV.1.f)

4.4 Information from sources other than the MLS (appraisal district records, tax rates, flood maps, school boundaries, census data and OfferQS calculations) is shown with its source and date, separately from MLS content. MLS content is never altered from what the MLS provides. (19.16)

4.5 You will not see: the type of listing agreement; seller or occupant names, phone numbers or email addresses; instructions or remarks intended for cooperating brokers; listings or addresses that a seller has directed be withheld from the Internet; or automated value estimates or third-party comments for a listing whose seller has asked that they be disabled. (19.15, 19.6, 19.7)

4.6 You may view or retrieve an unlimited number of active listings, but not more than 500 sold listings in response to any single inquiry. (19.19)

5. Prohibited use

You may not: scrape, crawl, harvest or bulk-download MLS Listing Information by any means; share your credential or let anyone else use your registration; use MLS Listing Information for any commercial purpose, including marketing, lead generation, valuation products, data resale or training any model or database; republish sold prices, listing histories, photographs or remarks anywhere; use the information to contact sellers, occupants or listing agents for solicitation; or circumvent any security or usage limit. We monitor for and act against scraping and misappropriation, and we may suspend or terminate your registration immediately for a suspected violation. (19.5, 19.10)

6. Accuracy complaints

Listing brokers may report inaccurate information added by OfferQS beyond what the MLS supplied by emailing support@offerqs.com. We correct or remove false information about a specific property within 48 hours of a communication explaining why it is false, except for good-faith opinion, advice or professional judgment. (19.8)

7. Privacy

Our Privacy Policy explains how registration information and your activity records are used, including the MLS record-keeping and disclosure described in section 1.3. (19.11)

8. Termination and changes

Your registration ends when your OfferQS subscription ends, when your credential expires without renewal, or when we terminate it for a violation. HAR MLS may require us to modify or discontinue this VOW at any time. We may update these Terms; continued use after notice is acceptance.

MLS Listing Information is © Houston REALTORS® Information Service, Inc. and the listing brokers. All rights reserved. Copyright complaints follow the DMCA procedure in the Terms of Service.
